EOR for Sales Teams in Portugal: Hire Without an Entity

If you want sales reps in Portugal but have no Portuguese company, an Employer of Record (EOR) is the fastest compliant route. The EOR becomes the legal employer on paper: it signs the contract, runs payroll, reports to Social Security and carries the employer obligations. Your team sells, and you direct their daily work. This guide covers how that works for sales roles specifically, what it costs in mandatory charges, which compliance traps catch foreign companies, and when an EOR is the wrong tool.

TL;DR

  • An EOR lets you employ SDRs, account executives or sales managers in Portugal without opening a local entity. The EOR is the legal employer, you manage the work.
  • Employer social security in Portugal is 23.75% of gross salary for profit-seeking entities, before holiday and Christmas bonuses are counted.
  • Missed Social Security deadlines bring penalties and interest, so the provider’s process matters more than its brochure.
  • Use an EOR to test the market or hire a handful of reps. Consider your own entity, or a managed sales team, when headcount and revenue justify it.

What an EOR does for a sales hire

A sales hire is different from a back-office hire. Reps need to start fast, often in a specific language, and their pay mixes fixed salary with variable income. Under an EOR model, the provider:

  • issues a Portuguese employment contract that complies with local law;
  • registers the employee with Social Security and the tax authority;
  • runs monthly payroll, payslips and statutory declarations;
  • handles leave, bonuses, absences and, if it comes to it, termination procedures.

You keep control of targets, territory, CRM, pipeline reviews and coaching. What you do not do is sign Portuguese employment paperwork or file anything with Portuguese authorities. For a deeper explanation of the model, see our guide on what an employer of record is and how it lets you hire in Portugal without a setup.

Why companies put sales teams in Portugal

The country’s pitch has moved beyond cheap labor. In the 2025 business services report, international companies named availability of qualified local talent (86%), competitive costs (77%) and language skills (65%) as their main reasons for choosing Portugal. A separate 2025 contact center benchmarking study found that the main drivers of outsourcing are now flexible growth capacity (88%) and access to specific technical skills (84%).

For a sales leader, that translates into practical things: reps who sell in English, Spanish, French, German or Portuguese from one time zone close to most of Europe, and the ability to add capacity quickly when a market opens up.

Which sales roles fit an EOR

Not every sales structure suits the same model. A quick way to sort it:

Situation Best fit
One to ten reps, you manage them directly EOR
Testing Portugal or Iberia for 6 to 12 months EOR
Hiring a country manager who will sign contracts locally EOR first, entity later
You want results, not headcount, and no management burden Sales outsourcing (SDR/BDR, lead generation, full-cycle)
Larger, stable team with long-term plans Own legal entity

The distinction between the first and fourth rows matters. With an EOR, the reps are your people, working inside your sales process. With sales outsourcing, a provider supplies a managed team that works toward agreed outcomes. We offer both, and which one you need depends on whether you want to own the sales management.

What a Portuguese sales employee costs you beyond salary

Quoted salary is not your cost. Mandatory employer charges and statutory pay items add to it.

Social security

For profit-seeking entities the total mandatory contribution is 34.75% of gross salary: 23.75% paid by the employer and 11% by the employee. The employee’s 11% comes out of their pay. The employer’s 23.75% is on top of it.

Holiday and Christmas bonuses

Full-time contracts typically include 22 working days of annual leave after the first year and two bonus payments, for Christmas and holidays, each equal to one month’s salary. Those bonuses can be paid in full in two installments or spread across the twelve monthly payslips, but either way the annual cost is fourteen months of base pay, not twelve. Foreign finance teams often miss this when they build a budget from a monthly figure.

Working time

The standard limit is 8 hours a day and 40 hours a week, with an 11-hour daily rest period. If your reps cover US-East afternoons or run late outbound blocks, design shifts around these limits from the start rather than discovering them after a complaint.

A worked example of the method

Take a hypothetical rep on a base salary of €2,000 a month. Fourteen payments give €28,000 a year. Employer social security at 23.75% adds €6,650. That is €34,650 before commission, equipment, software, the EOR’s fee and any benefits such as meal allowance or health insurance. The figures are illustrative, not an offer, but the logic holds: multiply base by fourteen, add 23.75%, then add everything else. Our employment cost calculator for Portugal lets you run your own numbers.

We do not publish a fixed EOR fee here, because it depends on the number of hires and the services included. Ask for the fee as a clear line, separate from the pass-through employment costs, so you can compare like with like.

Commission and variable pay: what to settle before the contract

Sales compensation is where EOR arrangements most often get awkward, because your home-country plan rarely maps cleanly to a Portuguese contract. Before the first offer goes out, agree these points with your provider in writing:

  1. How the plan is written into the contract. Commission and bonus rules should be documented, with the metrics, the payment timing and what happens on resignation or dismissal.
  2. Whether variable pay affects other entitlements. Ask specifically how regular commission is treated for holiday and Christmas bonus calculations, and get the answer from a Portuguese employment specialist, not from a generic template.
  3. Payroll cutoffs. Decide when deals are closed for commission purposes so payroll can include them in the right month.
  4. Currency and tax. The rep is paid in euros and taxed in Portugal. If your quota is in dollars or pounds, define the conversion rule in the plan.
  5. Non-compete and territory clauses. Portuguese law constrains what can be enforced. Have these drafted locally, not copied from another country.

The point is not that Portugal forbids incentive pay. It is that the plan must sit inside the Labor Code, not beside it.

Compliance: the parts that catch foreign companies

Portuguese compliance is administrative and deadline-driven. Two examples from Social Security guidance: a new employee must be reported within the 24-hour window before they start work, and the monthly payroll declaration (DMR) is due by the 10th of the following month. Missing either leads to penalties and interest. A provider that files by hand, or through an intermediary, is more exposed to those errors than one with direct access to the Social Security Direta portal.

There is also a principle your home contract cannot override. A foreign worker in Portugal has the same rights and duties as a Portuguese national. Your US or UK sales agreement template does not change that. The Portuguese Labor Code applies whatever the EOR’s service terms say.

Questions to put to any EOR provider

  • Who is the legal employer of my reps, and which Portuguese entity signs the contract?
  • How do you report new hires and file the monthly declaration, and who checks the filings?
  • Can you show a sample contract that includes a commission schedule?
  • What happens to my reps’ contracts if we leave your service?
  • What is billed monthly, and what is billed once?
  • Is the support team available in English?

How to launch a sales hire through an EOR

  1. Define the role and market. Language mix, seniority, quota, target accounts. Specific roles recruit faster.
  2. Choose the city. Lisbon and Porto are the main hubs, but the business services report notes that companies are looking at Braga, Aveiro and Coimbra to relieve saturation in the big cities. Regional hiring can lower costs and open untapped talent pools.
  3. Recruit. You can find candidates yourself or use local recruitment. Our guide on sourcing multilingual talent in Portugal covers the language question for sales roles.
  4. Agree terms and sign. The EOR issues the contract. The rep signs with the EOR, not with you.
  5. Onboard before day one. Social Security registration comes first, then equipment, CRM access and training.
  6. Run the monthly cycle. Commission data in, payroll out, declarations filed.
  7. Review at six months. Decide whether to stay on the EOR, expand, or move to a local entity.

A remote-team hiring routine also helps. Our checklist for hiring remote teams is a good companion for steps 1 to 5.

Where EOR is not the answer

Be honest with yourself about three cases.

You need someone to sign contracts or hold licenses in Portugal. An EOR employs people, it does not make your company a Portuguese company. That calls for an entity.

You want a large, permanent team. Past a certain size, running your own entity can make more sense. The reasons are control and branding, not legality. We support this route too, through our softlanding service, which covers setting up your own legal entity as well as visa and immigration support.

You do not want to manage sales at all. If you lack a sales leader to run the team, headcount alone will not produce pipeline. A managed team may suit you better.

Our perspective

We see the same pattern with sales hiring in Portugal. Companies arrive asking for a cheap way to place a rep, and the better outcome comes from treating the Portuguese team as part of the business rather than a cost line. The data points that way too: companies that treat their Portuguese operation as a strategic partner report higher retention and efficiency, according to the 2025 business services report.

Our specialty is Portuguese employment law and compliance, and that is where we put our attention in a sales setup: the contract, the commission wording, the Social Security reporting and the payroll cycle. We work in English, quote fees transparently and aim to have a team operational within days of agreement. Many clients begin with an EOR for two or three reps, then keep that structure, add a managed SDR layer or move to their own entity once the market has proven itself. We support all three paths, so our advice does not depend on selling you one of them.

Our practical rule: if you can name the person you want to hire and the customers they will call, start with an EOR. If you can only name the result you want, talk to us about sales outsourcing.

FAQ

Can an EOR hire sales reps in Portugal if my company has no entity there?

Yes. That is the main purpose of the model. The EOR employs the rep under a Portuguese contract and handles Social Security, tax and payroll, while you direct the daily work. You still need to be sure the role does not require your company to sign contracts or hold a license locally.

How much does it cost to employ a sales rep in Portugal through an EOR?

Start from gross salary paid fourteen times a year, then add 23.75% employer social security, commission, benefits and the EOR fee. Our employment cost calculator helps you estimate it for your own case.

Is EOR the same as sales outsourcing?

No. With an EOR, the reps are your employees in practice and you manage them. With sales outsourcing, a provider supplies and manages a team that works toward agreed objectives such as qualified leads or closed deals.

Does my home-country sales contract apply to a rep in Portugal?

Not as the governing document. Foreign workers have the same rights as Portuguese nationals, so the Portuguese Labor Code applies. Your commission plan can be adapted, but it must fit inside the local contract.
